That isn't the way our law works. I think the key issue is whether Chauvin was INTENTIONALLY trying to kill George Foster. I am unconvinced of that from the evidence we have seen so far, but perhaps the prosecution has evidence we are unaware of.
Murder in the 2nd degree requires intention. That is a very difficult if not impossible thing to prove in most instances and I actually doubt that is the case here. My guess would be that Chauvin is just an a-hole and was trying to show off his power to those begging him to let George up.
