If their intention was to kill? Seems like a rather interesting way to kill someone, by not shooting and first letting them come at you and try to stop you and take your gun.
No that logic doesn't reconcile.
What does reconcile is they used the gun to try and stop him from the crime he was committing (and the additional crimes he could have committed) and would have let the cops handle the situation.
Aubrey decided to end it right there on the streets.
