you're asking, and unless you're dumb, you'll understand that incarceration is about "protecting society" or "being punitive" - it doesn't address the infringement at all, which would be the point of private law in a libertarian society.

You wouldn't vote to set the penalty for Infringer A and Victim B, it would settled in a private court based on the framework and principles outlined in the piece.
