A red herring is something that misleads or distracts from a relevant or important question.

Of course, poor judgment is NOT a crime, and no one asserted that it was. Nor was she arrested for that. It was a diversion from the real issues at hand.
If he wanted to address the question honestly and head on he could have said that possession of drugs should not be a crime... or that she was entrapped.
