During the course of an investigation into Crime A, Crime B was committed. If not enough evidence was found during that investigation into Crime A, it doesn't mean that Crime B should be ignored. Crime B still happened.
Unless you're saying that we drop charges against all people who lied to law enforcement during investigations that came up empty, you aren't being consistent.
