rules for the trial. If they want Roberts to break a tie, they can vote to do that. If they don't want Roberts to break a tie, they can vote for that.

In Andrew Johnson's impeachment, the SC Justice broke a tie vote. The Senate believed he was acting with bias, so for the next tie vote, they disallowed it.
