as the populace doesn't seem interested in stopping it.

But, as for the constitutionality, the federal govt is very limited in what it can do. The constitution provides just a few enumerated powers and reserve all other powers to the states.

But, again, that's the constitution, and neither the federal govt nor most people care what it says anyway.
