think fines incentivize law enforcement improperly.

No, just points - aggregate behavior of risk shouldn't be ignored, imo.

I don't want gvmt fining or incarcerating anyone for violating laws which don't directly infringe on people, but just as with private law, I don't think it's sensible to ignore clearly risky behavior.
