aren't requesting asylum they are usually found guilty, sentenced to time served and repatriated comparatively rather quickly.
if they are requesting asylum it takes longer b/c there is a huge backlog. asylum requests are up exponentially. there are myriad reasons for this, some legit, some not so legit and some as a result of idiotic legislation such as automatic asylum hearings for minors from non-border countries.
keep in mind those caught sneaking in and requesting asylum in that manner are breaking the law. had they requested asylum in their own country at a US embassy or consulate or, for example, in Mexico in a US embassy or Consulate or at a Port of Entry then they wouldn't have broken the law at all. but since they decided to enter illegally and then retroactively request asylum they **** up the system b/c they broke the law.
this problem, as has been pointed out numerous times, is the asylum process takes longer than the 20 days they can legally hold children.
the solution is to just allow asylees to remain with their children through the adjudication process. the EO is trying this but it's at odds with the law.
the left's only solution seems to be to just catch and release. but something like 65% of those released in this manner never goes to their hearings. and something like only 1 in 5 asylees is granted asylum b/c they are getting lots of people especially those with minors falsely claiming it.
the whole problem is caused by incentivizing coming here with children through the Obama's Admin's catch and release program. although even he still prosecuted 20% of them.
the problem is exacerbated by Trump admin's policy of prosecuting everyone in the sense that the Flores decree and logistics make it hard to do that.
so either you streamline the process to take less than 20 days, you catch and release or you change the law or some combo.
personally, i'd like to see it streamlined and the law changed. i'd like to see Congress do that and have it not be done by EO.
