so do you believe him, or her? As I said, it's one of "credibility" and who you believe.
It's a horrible cause of action because it appears to depend upon the existence of a photo or the taking of a photo. But that, in no way, means it isn't true.
What if he told her he took a photo, but didn't? It's like someone calling in a bomb threat to create fear and apprehension, but not having a bomb. I'm not sure there's a crime here, but the political damage is done and I suspect that's what it was all done for anyway.
