you'd have to be able to prove on that exact day the lidar/radar was off. From my experience, the accuracy of machines rarely comes up in court. If somebody is initiating a traffic stop for 5mph they're just being a douche. They also better prove they enforce that rule all the time. I know an agency that cites people for 7mph over ... they're not well liked among other agencies.
