Constitution will be declaring it a right. Constitutional rights are a concrete thing, they are very easy to identify because they have went through a specific process of granting them that status. As opposed to your natural rights that have no origins or any specific criteria except someone deciding that it should be a tight.

Rights are not 'natural' they are defined and protected by man.
