THE ACA established health insurance as an individual responsibility that is punishable by a fine for those who do not secure insurance. Even those eligible for Medicare or medicaid must ENROLL in the program or face that fine.

It was justified by the SCOTUS as a Constitutional Law under Congress' ability to levy taxes.
