3) The Hatch Act prevents FBI employees from campaigning - the "system of recusal" prevents potential conflicts of interest, but it doesn't absolve him from any possible violations of the Act itself - like, handing out buttons or flyers near an voting location; or fundraising; or any other campaign activity that one might choose to participate in.
4) The fact that she lost the election is of no consequence - and if he were to make decisions about the Hillary investigation as a quid pro quo - that would be "obstruction" potentially, not a Hatch Act violation. They're separate and distinct.
