"Police say that Tilmon was above the “zero tolerance” threshold for underage drivers but he was under the limit for a DUI. Possession of alcohol by a minor is a Class D misdemeanor for a first-time offense."

this isn't difficult. the cops said he was intoxicated, but not enough to fail a sobriety test. if he was over 21, he would've been let free. because he was not 21, he gets the MIP. zero mentions in any article about having alcohol in his car.
