He was talking to Gaddafi's son, and he told the executive branch he was having the conversation beforehand to make sure it was legal. Seems pretty plausible that they either got a warrant or were already monitoring Gaddafi's calls. Kucinich says he was told Gaddafi's phone was a burner only used once, but that doesn't mean it couldn't be tracked. Not impossible to plant those with pre-existing monitoring.
