Trump used to make his decision.
The decision from the ninth was not based upon constitutional merits it was the courts deciding that their judgement trumped that of the president.
If this ruling is allowed to stand it removes the ability of the US to quickly react to a crisis. By declaring that anyone in the world has due process rights if another 9-11 type of incident were to happen the president would not have the power to immediately halt travel and the legislative branch is not designed for immediate actions.
