that, the opinion will be that it violates the establishment clause. there is a compelling argument it violates due process and the equal protection clause, as well. the weakest argument that it violates the immigration act “no person shall receive any preference or priority or be discriminated against in the issuance of an immigrant visa because of race, nationality, place of birth, or place of residence."
that's a pretty strong weakest claim.
but i do appreciate the preemptive "legislating from the bench" and "zany 9th circuit" bs.
