in Section V. Penalties....
they claim that because we didn't seek to put in controls until after the violation was discovered, it could not be considered "mitigation", the controls should have been in place before the violations occurred.....
Ummmm, who are these logicians?
If you put something in place BEFORE a problem exists, it's called "Prevention".....
to "mitigate" is to lessen the severity of a problem, which is exactly what the University did, when it sought to add controls after becoming aware of the problem. One can argue whether the problem should have been prevented in the first place, but their definition of "mitigation" is nonsensical.
