domestic investment... those who feel that they might be at risk of being deemed as criminals or negligent of harm to others would feel the most reticent to invest in assets that might be seized within the jurisdiction that those crimes or liabilities are most likely to be asserted and upheld by the courts in that jurisdiction.

Do you feel that the possibility of such an impact by possible investors in the future would be a valid reason to toss out the claims of those harmed by the crimes &/or negligence of malefactors?
