the government should prove it in court through due process. That’s it.

You are failing to recognize that immigration status can change. Someone here illegally like Musk, can get their status changed to legally work in the US, like what happened to Musk and Garcia.

The federal government issuing a work permit means they can legally work in the US. And that means they are no longer here illegally.
