Laws were originally based upon morality. Do not murder. Do not steal. They have morphed into something quite different.
"Malum in se" refers to an act that is inherently wrong or immoral in itself, regardless of whether it is prohibited by law, while "malum prohibitum" describes an act that is only considered wrong because it is specifically prohibited by a statute, meaning it is not inherently immoral on its own; essentially, "malum in se" means "evil in itself" and "malum prohibitum" means "evil because it is forbidden.“
