Congress put an expiration date on when states could ratify the amendment, but the Constitution does not provide for such a deadline...although perhaps Congress amcan set one. Five states apparently rescinded their ratification, but there's no provision for recission of that ratification. It's an interesting legal question that may never be resolved.
