Not really, but most charges against people are absurd. I got charged once for resisitng arrest without violence. when I was not even arrested yet. Judge did not dismiss it at all because I didn't want to spend $1000 that I didn't have for an attorney (years ago 1980's) I used a public defender and no matter what he brought up as the absurdity of it. They ignored him and charged me for it. This was in Texas.
