From information about the case he did. held the guy in a air choke for over 6 minutes causing him to die by Asphyxiation. I have observed a trial in Houston where there was a fight between an off duty cop and a martial artist over a girl. (Cops ex) cop kicked hit the asphalt and died, or he died and then hit the asphalt I do not remember. the officer was the aggressor but the other guy got convicted of manslaughter and spent 3 and a 1/2 years in prison. What Penny did was pure negligence, you never put anyone in an air choke unless you are trying to kill him. Blood chokes are different. What you see in MMA are Blood Chokes.
