According to witnesses he walked up behind him and got him a standing rear choke and took him down and held him there with other guys assisting in holding him down. Penny never adjusted his wind choke hold and held him there for six minutes when police got there he had a faint pulse but was really dead because they couldn't revive him. He was ruled dead by asphyxiation. Manslaughter. It is very sad.
