If Phelan was actually a spy, why wouldn't they jail him?

A lot of people, including Col. Douglas Macgregor, have been saying that NATO and the US in particular, have been intentionally goading Putin to invade Ukraine. We violated our promises to Russia multiple times, violated the Minsk Acords, were pushing to get Ukraine into NATO, which was yet another abrogation of promises we had made to Russia, overthrew the democratically elected president of Ukraine, who was friendly with Russia, and installed a puppet who had ties with Nazis in Ukraine (who were sworn enemies of Russia, of course), were arming and training Ukrainians to fight Russia, and were shelling citizens in eastern Ukraine who were pro Russia.
That is just a partial list.
I remember for a year or two before Russia invaded that Putin kept sending warnings to the West, that they were pushing too far and were seemingly aching for war. But we persisted.
Do you remember when the recording of Nuland hit the news? She had been told that our NATO allies in Europe were balking at some of the things the US was doing in goading Russia. Her response was F*ck the Europeans.
Now there are reports that there was even a bioweapons lab in eastern Ukraine. That had to be especially concerning given the gain of function research that the US had been funding on coronoviruses at the Wuhan Lab from which Covid-19 escaped. Russia had a lot of reasons to be on pins and needles with the continual aggressions and provocations from the Ukrainians and their NATO backers.
