NCAA can't penalize anyone from entering into a private agreement. Nor can they enforce any kind of age restrictions or limitations regarding whether or not a kid has signed to play for a school or not.
NIL rules are the same rules that apply to you and me. If you want to sign a deal to promote your local car dealership, the NCAA can't stop you. Or if you want your 12 year old to star in a tv commercial or make money promoting products on their YouTube channel, they're free to do so. NCAA can't interfere.
