its quite clear this money was for something very specific
that wasn't.

The thing you are really saying that if a client tells you they paid a lawyer and put it down as a retainer, a CPA
who does that is doing nothing illegal. Thats not what happened and its all documented (not like Ragliar Tigerboard documented, but actual written documentation).
