Yes, i think SCOTUS can overturn state laws that violate the US constitution and they have repeatedly done so. Which isn't to say i have agreed with every interpretation or ruling they have issued.
I just don't see how you could run a presidential election allowing all 50 states to kick POTUS candidates off the ballot for partisan reasons. Red states can have one election and blue states can have another I guess. Let's get the national divorce underway.
I just don't understand how a federal election for potus, the only national election, isn't subject to federal rules. seems wild to me that your position is that all the red states could get together and decide to not put Biden on the ballot or all the blue states got together and said they weren't putting Trump on the ballot and there's just no remedy other than the next election cycle you could theoretically vote those people out in a state election.
i guess you can disagree with the interpretation but it would seem to me that the 14th Amendment pretty clearly states CONGRESS can enforce section 3 not the supreme court of a particular state (other than for STATE offices)
