I am not aware of anyone saying the law had never been applied before. If they did, it appears from the information you provided they were wrong. The law was enacted for a reason, so it would be suprising if it had never been used. However, it was not enacted to pursue charge for a "crime" that had no victim. It had never been applied to a case of a loan application where the lending institution relies on their own appraisal. THAT is the point, and anyone that doesn't have their head where the sun don't shine could see it.
