Based on the Delaware case, he "cured" his tax evasion by subsequently paying the taxes, and the fines.
So, historically, DOJ has not prosecuted cases where the taxes have been settled.
That was the basis of the original plea deal for the taxes.
The hitch was immunity from prosecution on any other matters - that is where the judge had an issue.
Clarify: Why prosecute a case where the finances have been "cured"?
Prosecutor Admission: Throughout the document, Mr. Weiss presented an unflattering split-screen of Mr. Biden, scooping up millions in income and gifts from friends while stubbornly refusing to pay his taxes.
