Whispering Joe had documents he took when he was a senator. He is specifically not entitled to those.
Similarly, he stole documents from when he was vice president. He is specifically prohibited from doing that.
The President of the United States as in Donald J Trump, is authorized to unilaterally declassify any documents at any time for any reason. He will be charged, and have to stand trial during the election cycle but whispering Joe will not be charged.
No Republican is about the law. Even if they have to make the law up out of whole cloth.
