DOJ: your honor we want to make it so this diversion plan per the appeal must come to you to determine if he has violated the terms and we are agreeing that the doj cannot do it.
Judge: do you have any precedent for this?
DOJ: no but we believe it is necessary because of the politized nature of the defendant.
Judge: so you are trying to prevent a future doj that may not agree with you from enforcing this plea?
DOJ: yes
Judge: do you have any precedent for this? (she asked 5 times)
DOJ: no (all 5 times)
Judge: I don't think I can do this as it seems to violate the separation of powers as you are making the judicial branch do work designated to the executive and cannot show where this has ever been done before.
