And if it's your premise that somebody should charge them: Abortion is considered legal in the United States, just as murder of Jews was legal under the Nazi regime - therefore, no murder charges can be brought by domestic prosecutors.

Unfortunately, since abortion isn't considered a war crime, even if an occupying force was to take over, I don't think charges will be brought.
