That wasn't the point. The altitude poses challenges, yes, and those could likely be overcome, but there are secondary risks to be considered. That terrorist is on the ground where our weapons are designed to kill people and won't spread shrapnel or ordinance over hundreds of square miles of US territory.
The simplest explanation is the one the Pentagon gave. It doesn't pose any incremental risk re: surveillance, they are monitoring it closely and the risks involved with shooting it down over populated areas are too great. My bet is the moment it clears the coast it gets shot down.
