three-tiered system for a reason. The courts and legislature have stopped doing their jobs and have allowed the executive branch to reign unchecked.
Regardless of your opinions on the subject, Roe-v-Wade is a perfect example of this. The courts made a horrible ruling and for 50 years refused to reexamine it due to silly beliefs about precedence. Because of that, the legislative process was halted for decades and instead of eventually coming up with a political compromise we are where we currently find ourselves on the issue.
