If he did (as it appears) negotiate some additional compensation, it was up to him (and his accounting staff) to properly code that on his W-2/1099. Even if it was not coded correctly, he has the expertise in the tax law to know he has to report it.
Example: Years ago, when I was consulting, I had a client that failed to report my fees on a 1099. I still reported it as income. Why? Because I knew it was income and didn't want to go to prison for tax fraud.
