each state is independent and sovereign, which is exactly how king george in the treaty of paris recognized them. they are, in effect, their own independent country, complete with a head of state (governor), legislative body, and constitutions. these independent states joined together in a voluntary compact to form a confederacy and this confederacy formed a republic. In so doing they created a federal government that had have few and limited powers, which they wrote, debated, and eventually ratified as the Constitution. Only in some areas did they say they would cede some of their powers to that federal government, powers which they as independent states had. Coming off the US secessionary war against England and living under the tyranny of the crown, they were very skeptical and cautious to not have a federal government like that of England. The Bill of Rights was insisted upon for that very reason: it’s purpose was to further limit their creation.
The Bill of Rights does not apply to the states. It’s right there in the first five words: CONGRESS SHALL MAKE NO LAW
