an established doctrine called the "major questions" doctrine, which requires clear Congressional intent for the regulatory body to act.
That doctrine appears to have already existed, and apparently is widely ignored across the board.
I don't think this will change much. Court battles can take years. Regulatory bodies may not be too phased.
