Eastman was the proponent of the theory. In discussions with Pence's legal team, he admitted that it was fraught with constitutional issues on Jan 4 and then came in and requested that they do it anyway on January 5th. Thought it would fall under the Political Question doctrine and that the courts wouldn't touch it, but it would effectively buy them time.
