The federal prosecutors came at him with the full force of the US government and, of course, have very deep pockets. They were threatening him with a 5 year prison term and offered him 8 months in federal prison to plead guilty... he took their deal, though it was far worse than anything given to anyone else for similar crimes.
I remember reading a high powered attorney in Florida talking about the federal criminal system. He said that the federal prosecutors can have almost limitless budgets and federal judges tend to routinely look away at lying & other illegal & improper tactics that the federal prosecutors use to get convictions and that their conviction rates are something like 98%.
D'Souza wrote a book about his experience:
