But only certain people are charged with hate crimes.

If you walk down the sidewalk and randomly punch a black man in the face I guarantee you will be charged with a hate crime. If the roles were to be reversed there would be almost no chance of the other guy being charged with a hate crime.

The crime is the same, the motivation appears to be the same but the charges would be very different.

However, the chances of a black man being randomly attacked by a white man are far lower than the reverse.
