In the Brown case, and this is supported by eyewitness testimony before the grand jury, Brown was asked to get out of the middle of the road. The then physically and violently assaulted the officer, who then drew his weapon. Brown continued to advance on the officer who shot him advancing towards him.

Babbit was shot with no warning for trespassing. Period.
