I do not know anything about Wisconsin law but from my point of view they should have charged him with the weapons violation being under age and traveling across state lines into a possible hostile situation. since he had a gun and moved into the general vacinity of the protestors he could be tagged as the aggressor. That would make it 2nd or third degree murder.
