As with most other parts of the Federal government, it is more and more becoming a political tool with an agenda.

Their legal jurisdiction is already gone way too far, they don't need to go further.

Hef pointed out very clearly that the Patriot Act has given them lots of extra ammo for this extension of jurisiction...and that pretty much renews without a thought each time around.
