Clearly, he was drinking before he drove, he admitted to such.
Did the police do any field sobriety tests, or did they just send him to the hospital? I haven't heard.
2-3 drinks - if that's what he actually had, and not 5-6 drinks that he said were "2 or 3", at his size is probably not going to add up to the legal limit of 0.08% - probably closer to 0.04-0.05.
Without any sort of demonstration that he was impaired - a field sobriety test would be that - if his blood comes back <0.08% making a DWI charge stick in my non-legal opinion could be iffy.
It's completely possible that his behavior which has led to the tragic injuries of others won't even be able to be punished by criminal law other than some sort of C&I type ticket.
Of course, if he lied about the "2 or 3 drinks" then his BAC when it comes back could be more than 0.08%
