in the constitution. tons of restrictions on the 1st and 2nd amendments that aren't specifically enumerated.
personally, I think the constitution should probably be amended to say specifically, for example, the right of free speech shall not be infringed other than that incitement, defamation, fraud, obscenity, child pornography, fighting words, and threats may be restricted.
and really the same holds true for firearms. as much as I would prefer felons not have firearms the constitution makes no such distinction. making it illegal for them to have a gun rather than just relying on what they might do illegally with the gun is just something created by the courts.
