Congress was given the power to define and punish offenses against the Laws of Nations.
I've seen it argued that at the time of founding the Laws of Nations was commonly understood to include immigration.
and furthermore since meddling in immigration was prohibited until 1808 a logical person would assume that it means after 1808 it could be regulated.
if congress can define what an offense is under the Laws of Nations surely they could define that to mean immigration/migration.
