particularly criminal cases, you might be right. However, in a civil cases like these a portion of the physical evidence either never existed or was destroyed after use. Courts generally hold that failure to secure the evidence and/or maintain chain of custody indicates that the evidence was in opposition to the interests of the defendant and in favor of those of the plaintiff.
